A consumer court has awarded Rs 3.5 million as compensation for medical negligence during a caesarean section.

       Trichy: A private medical institution in Trichy was found guilty of two cases of medical negligence during caesarean sections and the District Consumer Disputes Redressal Commission awarded a total of Rs 3.5 lakh as damages.
       According to a recent report in the Times of India, the first hearing in the case took place on May 22. The plaintiff, a 26-year-old woman, alleges that during a cesarean section in September 2022, doctors mistakenly administered spinal anesthesia to the wrong nerve. Following the surgery, she experienced persistent physical impairment, including difficulty walking, sitting, and performing daily activities. Subsequent tests revealed a herniated disc.
       The Committee found negligence in the provision of spinal anaesthesia and concluded that there were deficiencies in the provision of services by the relevant medical personnel.
       The committee ordered the parties involved to pay 3 million rupees as damages and 15,000 rupees as legal costs, The Times of India reported.
       The second patient was a woman who underwent a cesarean section at a local clinic in Trič in February 2018. Following the surgery, she experienced chronic abdominal discomfort, and the symptoms persisted. Only almost a year later, imaging studies revealed the cause: a hypoechoic fistula measuring 26 x 6 mm in the subcutaneous tissue, formed by the remains of non-absorbable polypropylene sutures. Subsequently, in April 2019, she underwent corrective surgery, which included scar excision and fistula exploration to remove the remaining sutures.
       In its decision on May 23, the Consumer Protection Council found that the medical staff performing the surgery failed to ensure complete closure of the surgical wound and failed to provide adequate postoperative care. In its decision, the court found the case to be medical negligence and a violation of the terms of service under the 2019 Consumer Protection Act.
       The court thus ordered the clinic to pay the plaintiff compensation for medical negligence in the amount of Rs 500,000, medical and surgical expenses in the amount of Rs 52,000, and legal costs of Rs 10,000.
